Technology Intermediary Status (Section 79, IT Act 2000)
EventOye operates strictly as a digital marketplace intermediary. Event organizers, captains, and crew interact as independent contracting parties. Event listings, schedules, and venue directions are published directly by organizers.
1Nature of the Platform
EventOye is a technology-enabled workforce coordination tool owned and operated by Cobotra Agency / EventOye Technologies. Our platform provides discovery feeds, digital shift scheduling, GPS check-in verification, automated reputation tracking (XP System), and milestone payout escrow.
EventOye is not an event management company, venue operator, or temporary staffing agency. We do not exercise direct physical control over live event venues, private gatherings, or attendee security.
2Independent Gig Contractor Relationship
Nothing in these terms or on the EventOye platform shall be construed as creating an employer-employee, agency, partnership, or joint venture relationship between EventOye and any Worker, Vice-Captain, or Captain:
- Crew members choose their shifts voluntarily and retain full discretion over their working hours.
- Event Managers are solely responsible for ensuring safe working environments, adequate hydration, meals, and on-site briefing at the event venue.
- Workers are responsible for their own tax filings, GST obligations (if applicable), and personal insurance.
3Accuracy of Event Listings & Organizer Obligations
Event Managers publishing gigs on EventOye warrant that:
- All event listings represent lawful, genuine, and permitted public or private events.
- All necessary municipal, police, fire, and copyright licenses (e.g. IPRS / PPL / local police NOC) have been obtained prior to recruiting crew.
- Pay rates, overtime terms, and reporting times listed on shift cards are binding and will be honored upon satisfactory shift execution.
4Force Majeure & External Disruptions
Neither EventOye nor contracting organizers/crew shall be held liable for failure or delays in shift delivery resulting from causes beyond reasonable human control (Force Majeure):
- Acts of God, floods, severe storms, lightning, or earthquakes.
- Government-mandated curfews, Section 144 orders, or public health emergencies.
- Unannounced venue power outages, fire department shutdowns, or civic protests.
In Force Majeure circumstances, advance refunds and crew standby compensations are resolved equitably according to our Refund Policy.
5Zero-Tolerance Code of Conduct
To protect all participants in our community, EventOye enforces an uncompromising zero-tolerance stance on:
Harassment & Discrimination
Immediate platform ban and police reporting for physical, verbal, or sexual harassment against any worker, captain, or guest.
Substance Use on Shift
Strict prohibition of alcohol, narcotics, or intoxicating substances prior to or during any active event shift.
6Limitation of Liability
To the maximum extent permitted by applicable Indian law, EventOye Technologies, its founders, and affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of personal injury, property loss, or loss of profits occurring at an event venue. Our maximum aggregate liability under any claim shall not exceed the platform commission fee collected for the specific shift in question.
